Terms and Conditions for TAM Builders

1. Introduction

These Terms and Conditions (“Terms”) govern the use of services and website content provided under the brand name TAM Builders, operated by TextJesse, registered in the Netherlands (“TAM Builders”, “we”, “us”, or “our”).

By purchasing or using our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

2. Services

TAM Builders provides B2B market intelligence and data services, including but not limited to:

• Total Addressable Market (TAM) mapping

• ICP-based account list building

• Contact discovery and enrichment

• Stakeholder and decision-maker mapping

• Data segmentation and scoring

• Upsell and cross-sell opportunity mapping

• Outreach-ready dataset delivery

• GTM kickoff and advisory sessions

Services are delivered according to the selected package and agreed scope.

3. Scope of Deliverables

Each package defines maximum dataset scope, which may include:

• Maximum number of accounts

• Maximum number of contacts

• Enrichment fields included

• Segmentation and scoring criteria

Delivery is considered complete when the dataset has been delivered in file format (such as CSV, Excel, or similar), matching the agreed package scope.

Counts are based on qualified matches according to the ICP criteria provided by the client.

4. Client Responsibilities

The client must provide accurate and complete:

• ICP definitions

• Targeting criteria

• Industry and geographic filters

• Exclusion rules

• Existing customer lists (if applicable)

Project timelines begin only after all required intake information has been received and confirmed.

We are not responsible for reduced output quality caused by incomplete or inaccurate client inputs.

5. Turnaround Times

Standard turnaround targets (such as “5 working days”) are estimates, not guarantees.

Timelines depend on:

• Input completeness

• ICP clarity

• Market complexity

• Data availability

Delays caused by missing client input pause the delivery clock.

6. Data Sources and Accuracy Disclaimer

We use a combination of:

• Public databases

• Commercial data providers

• AI-assisted enrichment

• Human verification processes

While we apply quality controls, data accuracy, completeness, and timeliness are not guaranteed. Roles, employment status, and company details may change after delivery.

Client is responsible for validating data before outreach or commercial use.

7. Compliance With Outreach and Data Laws

Client is solely responsible for lawful use of all delivered data, including compliance with:

• GDPR

• ePrivacy rules

• CAN-SPAM

• CASL

• Other applicable marketing and data laws

TAM Builders provides data only and does not send outreach messages on the client’s behalf. Legal responsibility for outreach rests entirely with the client.

8. Client-Provided Data (Upsell / Cross-Sell Projects)

If the client provides customer or prospect data for enrichment or analysis, the client warrants that:

• They have the legal right to share the data

• Proper legal bases exist for processing

• Required notices have been given

We process such data strictly for service delivery purposes.

9. Advisory and Kickoff Sessions

Kickoff sessions and consulting calls include advisory guidance on:

• Segmentation

• Outreach strategy

• Copy direction

• Workflow setup

These are advisory only. We do not guarantee campaign performance, response rates, pipeline creation, or revenue outcomes.

10. Fees and Payments

Service fees are defined in the selected package or written proposal.

Payment terms:

• Invoices must be paid within the stated invoice period

• Work may start only after payment confirmation

• Late payments may delay delivery

All prices are exclusive of VAT unless stated otherwise.

11. Refund Policy

Due to the custom nature of data projects:

• Payments are non-refundable once work has started

• If cancellation occurs before work begins, a refund may be granted at our discretion

• Partial work completed may be billed proportionally

12. Intellectual Property

All methods, frameworks, scoring models, enrichment logic, and internal processes remain the intellectual property of TAM Builders / TextJesse.

Clients own their specific delivered dataset files, subject to the usage license in Section 7.

13. Confidentiality

Both parties agree to keep confidential any non-public business information exchanged during the project, including:

• ICP definitions

• Target markets

• Customer lists

• Commercial terms

14. No Warranty

Services are provided “as is” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.

We do not guarantee commercial results.

15. Limitation of Liability

To the maximum extent permitted by law, TAM Builders / TextJesse is not liable for:

• Indirect damages

• Lost profits

• Lost opportunities

• Regulatory penalties from outreach

• Data usage consequences

Total liability is limited to the amount paid for the specific project giving rise to the claim.

16. Termination

Either party may terminate a project before work begins. After work has started, termination does not remove payment obligations for completed work.

We may suspend services if:

• Client misuse occurs

• Laws are violated

• Payments are overdue

17. Governing Law

These Terms are governed by the laws of the Netherlands.

Disputes shall be submitted to the competent court in the Netherlands unless otherwise required by mandatory law.

18. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted with a revised date. Continued use of services constitutes acceptance.
